towmycar Platform Terms and Conditions
towmycar.co.za is a division of Hybrid Learning Solutions (PTY) Ltd ("towmycar", "we", "us").
1. Acceptance
By registering a towing company account, you confirm that you have the authority to bind the towing company named in this registration ("the Towing Company") to these Terms and Conditions, and to the Towing Company Partner Agreement issued to it separately.
2. The Platform
towmycar provides an online booking, towing_service-catalog, invoicing and customer-management platform through which members of the public may discover the Towing Company and book towing_services offered by it. The Towing Company is solely responsible for the accuracy of its listed towing_services, pricing, availability, and for honouring bookings made through the platform.
3. Platform Fee
towmycar charges the Towing Company a platform fee of R3.75 (excl. VAT) per non-cancelled booking made through the platform. Fees accrue monthly and are consolidated into a single invoice issued by towmycar shortly after the end of each calendar month, covering all non-cancelled bookings completed in that month. Invoices are payable within 14 days of the invoice date. towmycar may suspend the Towing Company's access to the platform for accounts that are more than 30 days in arrears.
4. Towing Company Obligations
The Towing Company agrees to: keep its towing_service catalog, pricing, and contact details accurate and current; honour bookings accepted through the platform; issue valid tax invoices to customers for completed work; and treat customer information obtained via the platform as confidential and use it only to fulfil bookings.
5. Data and Privacy
towmycar processes customer and booking data on behalf of the Towing Company in order to operate the platform. The Towing Company will not use customer data obtained through towmycar for purposes unrelated to fulfilling bookings made through the platform.
6. Term and Termination
This agreement remains in effect until terminated by either party on 30 days' written notice, or immediately by towmycar for material breach, including non-payment of platform fees. Fees accrued prior to termination remain payable.
7. Liability
towmycar provides the booking platform "as is" and is not a party to the towing_service contract between the Towing Company and its customers. towmycar's liability to the Towing Company arising from use of the platform is limited to the platform fees paid by the Towing Company in the three months preceding the claim.
8. Governing Law
These Terms and Conditions are governed by the laws of the Republic of South Africa.
9. Changes
towmycar may update these Terms and Conditions from time to time. Continued use of the platform after notice of a change constitutes acceptance of the updated terms.
